This E-Sign Consent explains how Three B Financial, LLC (dba 3BCash) delivers disclosures, agreements, and other communications to you electronically under the federal Electronic Signatures in Global and National Commerce Act (ESIGN Act), and what you need to do business with us this way.

Scope of This Consent

If you apply for a 3BCash loan, we need your consent to provide certain disclosures, notices, agreements, and other records ("Communications") electronically rather than on paper. Communications covered by this consent may include your loan agreement, Truth in Lending Act disclosures, privacy notices, account statements, servicing notices, and other legally required or account-related documents connected to your application or loan. By checking the consent box during the application process, you agree to receive these Communications electronically, typically by email, through the application partner's secure portal, or by posting to a page you can access online.

Your Right to Paper Copies

You can ask for a paper copy of any Communication we've provided electronically. To request one, contact us using the information below and tell us which document you'd like and where to send it. We do not currently charge a fee for a paper copy; if that ever changes, we will disclose the fee to you before providing the copy so you can decide whether to proceed.

Withdrawing Your Consent

You may withdraw your consent to receive electronic Communications at any time. To withdraw consent, contact us using the information below and let us know you're withdrawing E-Sign consent. Withdrawing consent does not affect the validity of any Communication provided electronically before your withdrawal takes effect. If you withdraw consent before a loan is completed, we may not be able to continue processing your application electronically, which could delay or prevent funding; if you withdraw consent after your loan is made, future servicing Communications for that loan may need to be provided on paper going forward, and reasonable processing time may apply.

Keeping Your Contact Information Current

To make sure you actually receive electronic Communications, you agree to keep your email address, phone number, and mailing address up to date with us. If your contact information changes, notify us promptly using the information below. We are not responsible for a Communication you don't receive because your contact information on file was outdated.

Hardware and Software Requirements

To receive, view, print, and save electronic Communications, you'll generally need: a device with internet access; a current web browser that supports 128-bit (or higher) encryption; an active email account, if Communications are sent by email; software capable of opening PDF files (such as a free PDF reader); and enough storage space or a printer if you want to save or print copies for your records. If our requirements change in a way that creates a material risk you won't be able to access future Communications, we'll notify you and confirm you still consent to receive them electronically.

How to Print or Save Your Documents

Most Communications are provided as, or can be viewed as, PDF or web-page documents. You can save a copy to your device using your browser's or PDF reader's "Save" or "Download" option, or print a copy using your browser's or PDF reader's "Print" option. We recommend saving or printing a copy of your loan agreement and any Truth in Lending Act disclosures for your records as soon as you receive them.

Your Consent

By checking the E-Sign consent box during the application process, you confirm that: you can access and view PDF and web-based documents on the device you're using; you consent to receive the Communications described above electronically instead of on paper; and you understand you may withdraw this consent at any time as described above. This consent applies to Communications related to your 3BCash application and any resulting loan; it does not, by itself, affect any separate consent you may give our online application technology partner, whose own terms and privacy notice govern the data you submit through that form.

Representative examples. A $500 loan repaid in 16 bi-weekly payments at 36% APR has payments of $35.05 and a total of payments of $560.87 (finance charge $60.87). The same $500 loan at 145% APR has payments of $48.05 and a total of payments of $768.78 (finance charge $268.78). A $1,000 loan repaid in 16 bi-weekly payments at 36% APR has payments of $70.11 and a total of payments of $1,121.74 (finance charge $121.74). These are examples only — your APR, payment amount and number of payments depend on the law of your state, the loan amount and your application; confirm your exact terms when you complete the application form. Rates and availability. Loans from $100 to $35,000 with terms from 7 days to 12 months. Rates and fees are standard and stay within the limits set by the law of the state where the loan is made. Loans are not available in all states. Approval is not guaranteed; the amount you qualify for depends on your income and application.

Credit check. We start with a soft credit inquiry that does not affect your credit score; a hard credit inquiry may be made before final approval. 3BCash does not report your payments to credit bureaus.

Funding. If your application is received and verified by 7:00 PM EST on a business day and approved, funds are generally deposited into your bank account the next business day. Availability of funds may depend on your bank.

Repayment. Loans are repaid in fixed installments with part of every payment going to principal. No rollovers and no prepayment penalty. Late or returned payments may result in fees permitted by your state's law and collection activity — contact us before a payment is due if you expect difficulty paying.

Right to cancel. You may cancel your loan without any finance charge by sending written notice by fax or email by 5:00 PM Mountain Standard Time on the next business day after your loan is made.

Responsible borrowing. Installment loans can be an expensive form of credit and are meant for short-term financial needs, not as a long-term financial solution. Borrow only what you can repay.

Military borrowers. We comply with the Military Lending Act. Federal law provides important protections to members of the Armed Forces and their dependents; in general, the cost of consumer credit to a covered borrower may not exceed a 36% Military Annual Percentage Rate. Equal Credit Opportunity. The Federal Equal Credit Opportunity Act prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to enter into a binding contract); because all or part of the applicant's income derives from any public assistance program; or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act.
